AGF Supports Decriminalization of Suicide: A Progressive Step Towards Mental Health Awareness

The Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN), has reiterated his support for the decriminalization of suicide in Nigeria, emphasizing that efforts are underway to review the current law. Fagbemi’s stance reflects the growing recognition of mental health as a national priority and the need to shift from punitive measures to more supportive solutions for individuals suffering from mental illness.

The AGF, speaking through his spokesperson Kamarudeen Ogundele, confirmed that the review of the criminalization of suicide is “a work in progress,” and further collaboration with stakeholders is necessary. This development follows a commitment made by the AGF in May 2024 when he received a delegation from the Asido Foundation, a non-governmental organization focused on mental health advocacy.

Advocacy for Change

Dr. Jibril Abdulmalik, founder of Asido Foundation, highlighted the importance of reviewing Nigeria’s legal framework surrounding suicide attempts. Abdulmalik pointed to medical evidence showing that 80% to 90% of individuals who attempt suicide are battling underlying mental illnesses, particularly depression. He urged the AGF to not only decriminalize suicide but also ensure the full implementation of the Mental Health Act, which was signed into law by former President Muhammadu Buhari in January 2023.

Abdulmalik’s advocacy underscores the need for a humane approach that considers mental health as a serious condition requiring treatment, not punishment. He remarked, “Punishing people who attempt suicide further stigmatizes those suffering from mental health issues, driving them away from seeking help.”

AGF’s Commitment to Mental Health Reform

In response, AGF Fagbemi acknowledged the need to reconsider Nigeria’s legal stance on attempted suicide, especially when the offender’s mental state is in question. He assured the public that any revisions to the law would be applicable across all states and that he would present the case for review before the Body of Attorneys General. “Health is a priority for this government,” Fagbemi emphasized, reiterating that his office is working towards practical solutions to support mental health initiatives.

Kamarudeen Ogundele, speaking on behalf of the AGF, also affirmed that the decriminalization process requires a coordinated effort among stakeholders, including legal experts, mental health professionals, and policymakers. “The AGF is passionate about mental health and remains committed to his promise to review the criminalization of attempted suicide. Nigerians should remain patient as plans are already in motion to address this important issue,” Ogundele noted.

The Mental Health Act: A Path to Progress

The decriminalization of suicide is seen as a crucial step in aligning Nigeria’s mental health policies with international standards. The Mental Health Act of 2023, though comprehensive, requires active enforcement to achieve its goals. The Act provides for the protection of the rights of individuals with mental health conditions and ensures access to quality care. Advocates like Abdulmalik believe that decriminalizing suicide attempts is integral to reducing the stigma around mental health and encouraging people to seek help without fear of legal consequences.

A Call for Patience and Collaboration

While the road to decriminalizing suicide may take time, the AGF’s support represents a significant step in the right direction. Mental health experts and civil society groups are optimistic that with the right legal framework, individuals struggling with mental health issues will receive the care and understanding they need, rather than facing criminal penalties.

As Nigerians await further action on this issue, the government’s commitment to reviewing and reforming outdated laws is a positive indication that mental health is finally being given the attention it deserves.
