Court Ruling Reinstates Baruwa’s Presidency Amid Union Disputes

The Nigerian Court of Appeal in Abuja has upheld the re-election of Tajudeen Baruwa as the National President of the National Union of Road Transport Workers (NURTW), nullifying the election of Musiliu Akinsanya, popularly known as MC Oluomo. This landmark judgment reaffirms Baruwa’s leadership and declares the election that positioned MC Oluomo as president invalid.

The appellate court’s decision, delivered on November 8, 2024, unanimously supported the March 2024 ruling by the National Industrial Court. That earlier judgment confirmed Baruwa’s leadership, deeming the controversial elections of October 2023, which MC Oluomo claimed as his mandate, unconstitutional and null.

The Journey to the Courtroom

The leadership crisis began when a faction within the NURTW sought to unseat Baruwa through an alternative delegate conference. The Court of Appeal emphasized that the election which declared MC Oluomo as the sole candidate lacked merit, aligning with the Industrial Court’s findings that the process violated union protocols.

The ruling, delivered by a panel of Justices Hamma Akawu Barka, Nnamdi Okwy Dimgba, and Asmau Ojuolape Akanbi, dismissed the appellants’ case, awarding costs of ₦100,000 against them. The court reiterated that Baruwa’s second-term election during the delegates’ conference in May 2023 was legitimate.
