Chief Justice of Nigeria Recommends Strategies to Prevent Conflicting Rulings

Justice Kudirat Kekere-Ekun, the Chief Justice of Nigeria (CJN), has proposed measures to address the issue of conflicting rulings among judges of courts of coordinate jurisdiction, especially within the Court of Appeal.

At the 2024 Annual Conference for Justices of the Court of Appeal in Abuja, themed “Judicial Introspection,” the CJN emphasized the need for judges to hold conferences to deliberate on reserved judgments. She explained that such collaborative discussions among judicial panels would minimize inconsistencies in rulings.

Justice Kekere-Ekun stated:

> “The issue of conflicting decisions is of great concern. One reason for this is that many panels do not hold conferences to discuss reserved judgments. Holding conferences and exchanging ideas is essential to maintaining consistency in our decisions. Several heads are better than one.”

The CJN urged presiding justices to prioritize these conferences, emphasizing that they serve as a critical tool for improving judicial processes.

Addressing Frivolous Allegations Against Judges

Justice Kekere-Ekun, alongside Attorney-General of the Federation (AGF) Lateef Fagbemi (SAN), decried the increasing trend of frivolous allegations against judges. Both emphasized that while genuine complaints would always be addressed, baseless accusations would attract consequences.

The CJN said:

> “The National Judicial Council (NJC) is committed to supporting judges who face unfounded complaints. We are exploring ways to ensure that such frivolous allegations have repercussions.”

AGF Fagbemi further warned that individuals who disparage the judiciary unjustly would face justice, describing judicial independence as vital to democracy.

Challenges Facing the Judiciary

Justice Kekere-Ekun acknowledged significant challenges, including public perception of inefficiency, funding limitations, and a growing backlog of cases. She suggested leveraging technology and alternative dispute resolution mechanisms to streamline case management and enhance efficiency.

She called for introspection to develop innovative strategies, reaffirming the judiciary’s commitment to ethics, accountability, and delivering justice effectively.

Prominent speakers at the event included former AGF Kanu Agabi (SAN), Body of Benchers Chairman Adegboyega Awomolo (SAN), and Federal Capital Territory Minister Nyesom Wike.

Agabi criticized the societal tendency to undermine the judiciary, noting:

> “Corruption has infiltrated every department of the nation, but judges should not bear the blame for the failures of society. It is unfair to vilify the judiciary for systemic challenges.”

Awomolo urged the NJC to protect judges from undue public attacks, emphasizing that the actions of a few errant judges should not define the entire judiciary.

Minister Wike pledged continued support for the judiciary, asserting:

> “An independent judiciary is crucial for justice to be seen and felt by the people.”
